If you do not agree to these terms, please discontinue use of our Services immediately.
2. Our Services & The “No Broker” Promise
Dhodir Real Estate acts as a premium, verified marketplace for residential and commercial rentals in Nairobi. We are fundamentally different from standard listing sites.
- 2.1. Zero Broker Policy: We do not allow brokers, middlemen, or unauthorized agents to list properties on our website. Only the direct Property Owner (Landlord) or their legally appointed Property Management Firm is permitted to list a space.
- 2.2. Registration & Verification Protocol
- Ownership Proof: Reviewing the official Title Deed or lease documents to confirm the person listing the property actually owns it.
- ID Verification: Cross-referencing the Landlord’s National ID/Passport and KRA PIN.
- Physical Inspection: Our team visits the site to confirm the property exists, matches the photos, and is vacant.
- To ensure the safety of our marketplace while respecting the privacy of our partners, we utilize a strict “Visit-First” verification model for all new Landlords and Property Managers.
- Step 1: Pending Status: Upon registration, your Landlord/Agency account will automatically be placed in a “Pending Approval” state. You will be able to access your dashboard, but you cannot publish live listings immediately.
- Step 2: The Physical Verification Visit: Our compliance team will contact you to schedule a brief, in-person visit to your building or site office. We do this to verify:
- That you are a real person and the legitimate manager of the property.
- That the building exists and meets our listing standards.
- Note: This in-person meeting replaces the need for you to upload sensitive ownership documents online, ensuring your data privacy.
- Step 3: Activation: Once our team has physically confirmed your status, your account will be fully Activated. You will then be able to post listings, which will go live on the website immediately..
3. Fee Structure (Strict Policy)
Our business model is designed to protect tenants and serve professional landlords.
3.1. FOR TENANTS: 100% Free Access
- No Viewing Fees: You are NOT required to pay any “viewing fee,” “gate pass fee,” or “booking fee” just to see a property.
- Authorized Payments Only: The only payments a tenant should ever make are:
- Rent & Deposit: Paid directly to the Landlord after a lease is signed.
- Service Charge: As stipulated in the lease agreement.
- Safety Warning: If anyone asks you for money via M-Pesa to “unlock” a viewing or “reserve” a house before you have seen it, DO NOT PAY. Report them to us immediately.
3.2. FOR LANDLORDS: Listing & Service Fees
- Listing Fee: Landlords are charged a service fee to list their property. This covers the cost of our verification team’s travel, background checks, photography, and marketing.
- Success Fee: In some arrangements, a commission may be applicable only after a successful tenancy agreement is signed.
4. Prohibited Conduct & The “3-Strikes” Ban Policy
We have zero tolerance for exploitation. To keep our marketplace safe, we enforce the following strict rules:
- 4.1. Illegal Charges: Landlords are strictly prohibited from charging tenants unauthorized fees (e.g., viewing fees, “tea” money, or bribes).
- 4.2. Reporting Mechanism: We encourage all users to report any Landlord who attempts to charge fees outside of the official Lease Agreement. Please report such incidents to support@dhodir.com or call +254 721 966 120.
- 4.3. The “3-Strikes” Rule: We take reports seriously.
- Strike 1 & 2: If we receive a verified report of a Landlord asking for illegal fees, they will receive a formal warning and a temporary suspension of their listing while we investigate.
- Strike 3 (Permanent Ban): Any Landlord who receives three (3) verified complaints regarding unauthorized fees or attempted extortion will have their account permanently banned immediately. Their listings will be removed, and they will be blacklisted from ever using Dhodir Real Estate again.
5. Accuracy of Property Information & Disclaimers
While we verify listings, the Nairobi rental market moves quickly.
- 5.1. General Guidance: Descriptions, dimensions, and references to condition are given in good faith but are for guidance purposes only.
- 5.2. Verification Responsibility: Tenants must satisfy themselves by physical inspection. It is your responsibility to verify details (e.g., water pressure, noise levels) before signing a lease.
- 5.3. Photos: Photographs may not strictly depict the property’s current condition due to recent wear and tear or furniture changes.
- 5.4. Utilities: References to “constant water supply” or “backup generator” are based on information at the time of listing. We do not guarantee the reliability of third-party providers (e.g., Nairobi Water, KPLC).
- 5.5. Pricing Changes: Rental prices are subject to change without notice until a Letter of Offer is signed.
6. User Obligations & Cybersecurity
- 6.1. Account Security: You are responsible for maintaining the confidentiality of your account details.
- 6.2. Email Security Recommendation: Real estate records (leases, IDs) are often retained for legal compliance for up to 7 years. For your own cybersecurity hygiene, we strongly recommend using a general-purpose “public” email address for inquiries and transactions on this site, rather than a highly sensitive private or banking-related email account.
7. Limitation of Liability
To the fullest extent permitted by Kenyan law:
- “As Is” Basis: Our website is provided “as is” without warranties of any kind.
- Third-Party Actions: Dhodir Real Estate is not liable for the actions of Landlords (e.g., withholding deposit) or Tenants (e.g., damaging property). We are the facilitator, not the contracting party.
- Damages: We shall not be liable for any indirect or consequential damages arising from your use of our site.
8. Governing Law
These Terms shall be governed by and construed in accordance with the Laws of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi.
